Bill C-45

Organizations have always been subject to criminal prosecution with respect to criminal negligence and the performance of prohibited acts, but proving a breach of legal duty in the past has been difficult. Growing public outcry and mounting pressure following several recent industrial accidents have resulted in the introduction of Bill C-45, which is an act to amend the Criminal Code of Canada.

Bill C-45 re-defines and expands organizational accountability within the Criminal Code and introduces a new Occupational Health and Safety (OHS) duty that may hold organizations and their representatives criminally liable for any workplace-related injury or death.

IMS Interactive has partnered with Gowlings' Occupational Health and Safety Practice and Norm Keith, B.A., LL.B., CRSP, in the development of the Bill C-45 online course. This course is designed for anyone in a position to help ensure that their company is compliant with the new Criminal Code provisions resulting from Bill C-45 - from the employee to the CEO.

Topics covered include:

  • The issues prompting the introduction of Bill C-45
  • How the new Criminal Code provisions resulting from Bill C-45 impact organizational accountability
  • How Bill C-45 impacts OHS in the workplace; and
  • What measures can be taken to prevent or limit liability in the case of a workplace accident

Bloodborne Pathogens

The potential for transmission of illness or disease such as HIV, Hepatitis B, or other bloodborne pathogens is an ongoing concern employers and employees in any workplace, as well as emergency response personnel.  Any situation in which blood is present in the work environment provides a risk of infection from bloodborne pathogens through contact with the skin or mucous membranes or by penetration of the skin.

Therefore, it is important for employees to know and to understand fully the potential dangers that bloodborne pathogens can pose in the workplace, as well as the standard precautions that they should regularly follow in order to prevent exposure to these pathogens.

The IMS Interactive Bloodborne Pathogens Online Training course provides a basic awareness of bloodborne pathogens in the workplace in order to help reduce the risk of occupational exposure to blood and other bodily fluids.

Upon completion of this course, participants will be able to:

  • Describe what bloodborne pathogens are and where they are found
  • Understand what Hepatitis B and HIV are and the possible occupational risks to workers
  • Recognize and apply the Standard Precautions
  • Know how to protect themselves by using Personal Protective Equipment

Electrical Safety

Since the mid-1800s, electricity has been an essential part of our everyday lives. It lights up our homes, cooks our food, and powers our computers and workplace equipment. However, electricity can be taken for granted, and the danger that it can pose when it is not properly handled can be forgotten.

Failure to follow effective electrical safety procedures can result in serious injuries, including falls after anelectric shock, electrical and thermal burns, loss of muscle control, electrocution, etc. It can even result in fatalities.

Therefore, it is important for employees to know and to understand fully the potential dangers that electricity can pose in the workplace, as well as what can be done as part of a daily work routine to reduce their risk from electrical hazards.

The IMS Interactive Online Electrical Safety course will provide employees and supervisors with a basic awareness of electrical safety and control measures that can prevent accidents and injury due to electrical hazards.

This online course focuses on the potential hazards that electricity can pose in the workplace and is designed to help participants:

  • Understand the fundamentals of electricity

Hazard Assessment for Daily Operations Online Course

Health, Safety, and the Law

In Canada, employers and supervisors have health and safety obligations to the employees who work under their direction and for the work area over which they have authority. While these obligations may vary slightly from province to province, they share a common general duty clause: “to take every reasonable precaution to protect the safety of a worker”.

In addition, employers must ensure that they hire competent supervisors who are knowledgeable about workplace processes, hazards existing in the workplace, and applicable Occupational Health and Safety laws.

Although many supervisors may be familiar with processes in their workplace and the hazards associated with these, they might not be considered “competent” in terms of their knowledge and obligations under Occupational Health and Safety laws and Bill C-45.

IMS Interactive’s Health, Safety, and the Law online training course will help supervisors fully understand their responsibilities under health and safety legislation.

Course topics include:

  • Overview of the Act and its Structure
  • Internal Responsibility System
  • Due Diligence
  • Enforcement
  • Employer Responsibilities
  • Supervisor Responsibilities
  • Worker Responsibilities
  • Joint Health & Safety Committee Roles
  • Worker Rights
